EPA Extends the Comment Period for its Request for Public Comment on Standards for “Small Manufacturers and Processors” for TSCA Reporting

As required by section 8(a)(C) of the amended Toxic Substance Control Act (TSCA), EPA posted a notice for public comment on December 15 on the standards for “small manufacturers and processors” used in connection with reporting regulations under TSCA section 8(a).

The standard defines what constitutes “small manufacturers and processors” for purposes of this section in TSCA. Specifically, EPA is seeking input on whether a revision of the existing standards is warranted. “Small manufacturers and processors” are exempt from certain reporting requirements under TSCA.

The EPA has also consulted with the Small Business Administration (SBA) on this matter. In order to provide adequate opportunity for the public to consider the results of EPA’s consultation with SBA, EPA is reopening the comment period for 15 days.

Comments on the notice must now be received by May 24, 2017. In the event that EPA determines that a revision to the standards is warranted, any such revision would occur by subsequent rulemaking, which would involve a further opportunity for public notice and comment.
