EPA Sends Proposed TSCA Fee Rule to OMB, Expected to Be Released Publicly in February

The Environmental Protection Agency has provided the Office of Management and Budget with its proposed rule on collecting industry fees to fund TSCA implementation. The proposed rule allows EPA to defray a portion of the costs of administering the following activities: 

  • Section 4 procedures for the testing of chemical substances to determine whether they have adverse health or environmental effects; 
  • Section 5 procedures for evaluating new chemicals and significant new uses; 
  • Section 6 risk prioritization and evaluation procedures). 

EPA’s recently published regulatory agenda indicates the proposed rule will be publicly released in February 2018, with the final rule to be completed September 2018.
