Background on the SPCC Plan

The Environmental Protection Agency (EPA) published a final rule on July 17, 2002, amending the Oil Pollution Prevention regulation (40 CFR Part 112) promulgated under the authority of the Clean Water Act. This rule includes requirements for Spill Prevention, Control and Countermeasure (SPCC) Plans, as well as Facility Response Plans (FRPs). It also includes new subparts that outline requirements for various classes of oil, revises the applicability of the regulation, amends requirements for completing SPCC Plans, and other modifications. EPA has amended the plan in both December 2008 and November 2009. The November 2009 amendments revise the December 2008 amendments as a result of EPA's review of comments and consideration of all relevant facts. Apart from minor technical corrections, EPA left the majority of the December 2008 provisions intact. The 2009 amendments, however, modified the December 2008 rule by removing the provisions to exclude farms and oil production facilities from the loading/unloading rack requirements, exempt produced water containers at an oil production facility, and provide alternative qualified facilities eligibility criteria for an oil production facility. Read more.
